1. Copyright and ownership

Unless expressly stated otherwise, all photographs, image sequences, texts, captions, graphics, logos, design elements and the selection and arrangement of content on this website are owned by Tomasz Czechowski /czechowski.art or used with the permission of the relevant rights holder. Copyright protection does not depend on the presence of a watermark or copyright notice. Access to the website does not transfer ownership and does not grant any licence to use its contents.

2. Permitted use

You may view the website for personal, non-commercial purposes and share ordinary links that direct users to the original page. Technical copies made automatically and temporarily by a browser solely to display the website are permitted. Uses permitted by applicable mandatory law remain unaffected, including relevant German and European copyright exceptions and limitations and, where United States law applies, fair use. Any such use must remain within its lawful scope and include attribution where required.

3. Uses requiring prior written permission

Except where mandatory law provides otherwise, you may not download, copy, reproduce, screenshot for republication, print, publish, upload, distribute, transmit, publicly display, make available, sell, license, rent or otherwise exploit any photograph or other protected content. You may not use it in advertising, editorial products, social media posts, websites, applications, merchandise, prints, exhibitions, databases, stock libraries, digital collectibles or NFTs. You may not crop, recolour, retouch, add filters or text, create adaptations or derivative works, remove credits, metadata or watermarks, hotlink or frame images, or imply authorship, endorsement or affiliation.

4. Automated use and artificial intelligence

Automated extraction, scraping, crawling beyond ordinary search-engine indexing, systematic downloading and data mining are prohibited except to the extent applicable law permits them and does not allow their exclusion. The rights holder expressly reserves, to the fullest extent permitted by law, all rights for text and data mining. The content may not be used to create or enrich datasets, embeddings or archives, or to train, fine-tune, test, benchmark or operate machine-learning or generative-AI systems. It may not be used as a prompt reference, image-conditioning input or source for synthetic images, style imitation, facial recognition or similar analysis without prior written permission.

5. Permission and licensing requests

To request permission, contact tomczeart@gmail.com and identify the photograph, intended purpose, media, territory and duration of use. Permission is valid only when granted in writing and only within the stated scope. Silence, the technical ability to save an image, or previous publication of an image does not constitute consent.

6. People, property and third-party rights

Photographs may depict identifiable people, private property, artworks, architecture, trademarks or other protected subject matter. Access to a photograph does not grant any rights relating to a persons image, privacy, publicity, trademark or property. Anyone wishing to reuse a photograph is responsible for obtaining every additional consent or clearance required for the intended use.

7. Reporting infringement

If you believe content from this gallery has been used without permission, or that material displayed here infringes your rights, contact tomczeart@gmail.com. Please include your contact details, the relevant page or image, the location of the disputed use, a description of the rights concerned and any supporting information.

8. Website availability and responsibility

The gallery is provided for viewing and may be changed, suspended or withdrawn at any time. Reasonable care is taken in presenting the content, but uninterrupted availability, compatibility and freedom from technical errors cannot be guaranteed. External websites linked from this site are operated by third parties and remain their responsibility. Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

9. Changes and applicable law

These Terms may be updated when the website, applicable law or the way the gallery operates changes. The version published on this page applies from its stated update date. If any provision is invalid or unenforceable, the remaining provisions continue to apply. These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer, this choice of law does not deprive you of mandatory protections that apply in your country of habitual residence. Jurisdiction is determined by the applicable statutory rules.
